OFFICIAL SWEEPSTAKES RULES

SWEEPSTAKES DESCRIPTION:

The 2013 ESSENCE Festival™ Flyaway sweepstakes (“Sweepstakes”) will begin on May 3, 2013 and end on May 10, 2013 (“Sweepstakes Period”).    Fifteen (15) qualifiers will each be awarded a one (1) year subscription to ESSENCE Magazine.  Two (2) finalists will each be awarded a VIP package to see Ginuwine in concert at the Hollywood Casino in West Virginia.  One (1) grand prize winner will be awarded a trip for two (2) to New Orleans, LA to attend the The 2013 ESSENCE Festival™ Presented by Coca Cola®
.

HOW TO ENTER:

Listeners of WKYS-FM who are legal residents of the U.S. residing within the Washington, DC metropolitan area, and are 18 years of age and older will be able to take part in this Sweepstakes. To participate in the Sweepstakes, listeners must do the following:

1. Sweepstakes participants must register online through the Station’s website at kysdc.com.

2. Upon entering the Sweepstakes website, participants are to follow the on-screen instructions, including entering their name, date of birth, address, phone number, email address, and any optional or additional contact information, as requested, to register for a chance to win.

3. After completing the registration process, qualified entrants will be eligible for a chance to win.

4. All Internet entries must be received by 11:59pm EST on May 8, 2013, or they will be void.

5. One entry per person per day per email address during the Sweepstakes Period.

6. In the event of a dispute regarding the identity of a participant’s online entry, the entry will be deemed to have been made by the authorized holder of the e-mail account at the time the entry was made.

7. Fifteen (15) qualifiers will be selected by random drawing from among all eligible entries received through online registration, and awarded the qualifying prize. 

8. Three (3) finalists will be selected by random drawing from among the fifteen (15) qualifiers.  Two (2) of the finalists will be awarded the VIP prize package and one (1) finalist will be awarded the grand prize trip to the

9. Prizes will be awarded upon winner verification and final approval by WKYS.

ELIGIBILITY RESTRICTIONS:

1. The Sweepstakes is open to listeners of WKYS-FM who are 18 years of age and older and are legal residents of the U.S. residing within the Washington, DC metropolitan area.

2. Employees of WKYS-FM, Radio One, Inc. (“Radio One”), its subsidiaries, affiliates, advertisers, competitors, general sponsors, promotional partners, other radio stations in the Washington, D.C metropolitan area, and members of the immediate families or those residing within the same households (whether related or not) of any of the above are NOT eligible to participate or win in this Sweepstakes.  For purposes of this Sweepstakes, immediate family members mean spouses, parents, grandparents, children, and siblings and their respective spouses.

1. Once an individual wins a prize in this Sweepstakes, they are not eligible to win another prize in this Sweepstakes except as specified within these rules.

1. Travel guest of grand prize winner must also be eighteen (18) years of age or older and a legal resident of the U.S.  Winner and guest will each be required to possess a valid driver’s license or other valid government-issued photo I.D. prior to departure and must travel on the same itinerary.  Travel guest will be required to sign and submit all requested release forms along with the grand prize winner.

5. Persons who have won a prize in another sweepstakes or promotion of any kind from WKYS-FM within the thirty (30) day period immediately preceding the start date of this Sweepstakes are not eligible to participate.  Only one person per family or household (whether related or not) may win in any promotion from WKYS-FM during any thirty (30) day period.

PRIZES:

1. Qualifying prizes to be awarded will include the following:

Fifteen (15) qualifiers will each be awarded a one (1) year subscription to ESSENCE Magazine (ARV $50)

1. Finalists prizes will include the following:

Two (2) finalists will each be awarded a VIP package to see Ginuwine in concert at the Hollywood Casino in West Virginia.  Package includes (i) VIP seating at the concert; (ii) Meet and Greet; and (iii) overnight hotel accommodations for two (2) at the Inn at Charles Town Casino Hotel on May 26, 2013 (one (1) standard room, double occupancy).  Transportation to and from the event venue, hotel room service, gratuities, meals, souvenirs and incidentals and all other costs will be the responsibility of the winner and his or her guest.  The estimated retail value of the VIP Package is Three Hundred Fifty Dollars ($350).  If the actual value of the prize is less than the stated approximate retail value, the difference will not be awarded in cash.

1. Grand Prize package for one (1) winner will include the following:

The 2013 ESSENCE Festival™ Presented by Coca Cola®; hotel accommodations for three (3) nights; one (1) standard room, double occupancy, July 5-7, 2013; and two (2) tickets to attend

2013 ESSENCE Festival™ Presented by Coca Cola® concerts / events. The trip must be taken during the 2013 Essence Music Festival weekend July 5-7, 2013.  Additional ground transportation, luggage costs, meals, beverages, hotel room service, gratuities, souvenirs, incidentals, and all other costs will be the responsibility of the winner and his or her guest.  The estimated retail value of the prize trip is Two Thousand Seven Hundred Fifty Dollars ($2,750).  If the actual value of the prize is less than the stated approximate retail value, the difference will not be awarded in cash. 

1. To the extent that prize elements are provided by third-party providers, winner agrees to look solely to applicable prize providers with respect to any claims, losses, or disputes in connection therewith.

1. Dates and times of concerts, events, activities, and trips promoted by event sponsors are subject to change and those changes are deemed to be beyond the control of WKYS and Radio One.  Changes of venue, cancellation of engagements by performing artists, and/or their management may be permanent in nature.  WKYS and Radio One are not obligated to make any effort to find an alternative prize under these circumstances.

1. No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except as determined by station management and/or the sponsor in its sole discretion.

1. All Sweepstakes winners must sign and date official station release and waiver forms as requested.  Failure to do so will result in winner forfeiting the prize.

1. If for any reason a Sweepstakes winner decides not to accept an awarded prize, the winner may be required to sign a release form acknowledging forfeiture of the prize.  It will be at the discretion of the sweepstakes sponsor and / or sweepstakes administrator if another entrant is to be selected as the winner if time permits.

1. If a Sweepstakes winner does not claim their prize by 5pm on May 17, 2013, the prize will be forfeited.

1. Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.

1. In the event any winner is found to be in violation of these Official Rules or is otherwise determined by the station, in its sole discretion to be ineligible, he/she may be required to forfeit the prize or to reimburse the station and / or any sponsor for the stated value of the prize if such a violation is found after the prize has been used by the winner.

EXECUTION:

1. During the Sweepstakes Period, eligible listeners will be encouraged to participate in the Sweepstakes by registering online through the WKYS website at kysdc.com.

1. The grand prize drawing will take place on May 10, 2013.

1. All winners will be notified by phone and email.

1. The Sweepstakes will progress in the following manner: 
   1. Listeners will be encouraged to register on-line at the WKYS web-site through the 2013 Essence music festival fly away banner at kysdc.com
   2. Online entries must be received by 11:59pm on May 8, 2013
   3. Fifteen (15) qualifiers be selected by random drawing from among all eligible entries received electronically and will be awarded a one (1) year subscription to Essence magazine,
   4. Three (3) finalists will be selected by random drawing from among all eligible entrants that qualified during the Sweepstakes Period.  The three (3) finalists will be announced on the air.
   5. Two (2) finalists will be selected at random and awarded the VIP Package to see Ginuwine in concert
   6. One (1) finalist will be awarded the grand prize trip to the 2013 Essence Music Festival
   7. Winners will be notified by station personnel
   8. The grand prize winner will be announced on-air.
   9. All winners will be instructed to come to the offices of WKYS to claim their prize

1. All decisions made by WKYS-FM and Radio One management regarding any aspect of this Sweepstakes are final.

GENERAL CONDITIONS:

1. Winners are responsible for all applicable taxes associated with the receipt of the prize.

1. Any person winning over $600.00 in prizes will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law.

1. No purchase necessary.  Sweepstakes is void where prohibited.  Sweepstakes is subject to all applicable federal, state and local laws and regulations.

1. Odds of winning depend upon the number of eligible entrants participating during the Sweepstakes Period.

1. By participating in the Sweepstakes, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this Sweepstakes, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation, and must sign a publicity release prior to acceptance of the prize.  By entering this Sweepstakes, each participant agrees to comply with the Official Rules and the decisions of the Sweepstakes sponsor which shall be final and binding in all aspects relating to the Sweepstakes.  

1. All Sweepstakes winners will be required to sign a liability release prior to acceptance of any prize.  Pursuant to the liability release, the winner or winners will agree to hold WKYS, Radio One, any other Sweepstakes parties and each of their respective affiliates, subsidiaries, agencies, officers, shareholders, directors, employees, agents and representatives of each of the foregoing, harmless against any and all claims or liability, directly or indirectly related to or arising from or in connection with Sweepstakes participation or the acceptance, possession or use / misuse of awarded prize or any portion thereof, or participation in prize-related activities, including but not limited to any related travel.        

1. Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.

1. The station retains the right to disqualify any entrant if all Sweepstakes rules are not followed.   Sweepstakes void if prohibited by law.

1. So long as no participant is materially adversely affected, the station reserves the right to make changes in the Sweepstakes rules, which will become effective upon being announced on the air and / or posted online.

1. WKYS, Radio One, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any entrant to complete or continue a telephone call, facsimile transmission or internet registration or text entry due to equipment malfunction, busy lines, inadvertent disconnections, unavailable network, server, Internet Service Provider (ISP) or other connections, communication failures or human error that may occur in the transmission, receipt or processing of entries.  In addition, WKYS, Radio One, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for lost, misdirected, mutilated, illegible or incomplete Sweepstakes entries.  Once submitted, entries become the property of the station and will not be returned.

1. By accepting the prize, the winner acknowledges that WKYS and Radio One have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.

1. WKYS, Radio One, its subsidiaries, its affiliates, participating sponsors and promotional partners will not assume any responsibility for any changes in the execution of the Sweepstakes, including; cancellation of the Sweepstakes as a result of the occurrence of events not within the control of WKYS, Radio One, its subsidiaries, affiliates, participating sponsors, promotional partners and other radio stations, such as acts of God, strikes, terrorists acts or criminal acts of third parties.  In the event, such an act should occur, the station may in its sole discretion, offer the winner comparable prize(s) currently being offered by the station in lieu of the prize originally awarded.      

1. If for any reason, the Sweepstakes is not capable of running as planned, including without limitation, any suspected evidence of tampering or technological corruption or if any portion of the Sweepstakes is compromised by virus, bugs, worms or unauthorized human intervention, fraud, an insufficient number of qualified Sweepstakes entries, or any other causes beyond WKYS and Radio One’s, control which, in WKYS and Radio One’s sole opinion, corrupts, threatens or impairs the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, WKYS and Radio One reserve the right to cancel, terminate, modify or suspend the Sweepstakes at their sole discretion.

1. Copies of Sweepstakes rules are available upon request during regular business hours, Monday – Friday 9:00 a.m. to 5:00 p.m., in the offices of WKYS, located at 8515 Georgia Avenue Silver Spring, MD 20910.  Copies of Sweepstakes rules may also be made available during on-site / in-person remote events.
