Prince George’s County Health Department’s “Give Drugs a Bad Rap” Music Contest

OFFICIAL CONTEST RULES

 

CONTEST DESCRIPTION:

The Prince George’s County Health Department’s “Give Drugs a Bad Rap” Music Contest (“Contest”) will begin on June 18, 2012 and end on July 18, 2012 (“Contest Period”).   The top twenty-five (25) entries will be awarded a prize pack;  ten (10) semi-finalists will be awarded the opportunity to record their entry song at a professional recording studio in Baltimore, MD and will receive a CD containing the professional recording of their entry song (retail value: $400);  three (3) finalists will each be awarded three (3) tickets to the 93.9 WKYS Russ Parr Summer Takeover where their entry songs will be played before the event audience; and one (1) grand prize winner will be awarded one (1) $300 Visa gift card.

HOW TO ENTER:

Listeners of 93.9 WKYS-FM who are legal residents of the United States residing within Prince George’s County, MD and are 13-24 years of age will be able to take part in this Contest.  To participate in the Contest, listeners must do the following:

  1. Contestants must submit a video of themselves singing an original rap, song, or poem to the provided “Give Drugs a Bad Rap” 93-second music beat.  No covers or sampling of other artists’ material or music is permitted, and will lead to disqualification.

  1. Upon entering the Contest website, contestants are to follow the on-screen instructions, including entering their name, date of birth, address, phone number, email address, video entry, and any optional or additional contact information, as requested, to register for a chance to win.  Parental permission will be required for any entry submitted by a participant under the age of 18.

  1. Using the provided “Give Drugs A Bad Rap” 93-second music beat, contestants are to create their own original 93-second song, rap, or poem.  Each entry must include AT LEAST three (3) of the following anti-drug and/or anti-alcohol messages to qualify:
  • Smoking makes you, your clothes, hair, and breath stink, so others won’t want to be around you.
  • Smoking makes it hard to breathe, which means you won’t be very good at sports.
  • Drinking alcohol can make it difficult to remember things, making school and work even harder.
  • Alcohol is a depressant, which means it can make you unhappy.
  • Binge drinking is dangerous and could kill you.
  • Drinking alcohol makes you do embarrassing things, like fall down or throw up.
  • If you drink and drive, you could hurt or kill yourself or others.
  • If convicted of Driving Under the Influence (DUI), you could face a year in jail, over $1,000 in fines and fees, 12 points on your license, a suspended license, loss of car insurance, and extremely high insurance rates.
  • Marijuana can cause you to make dangerous decisions that can hurt you or others.
  • Smoking marijuana before or while driving is unsafe. You could kill yourself or others.
  • Using pills to get high, using pills that aren’t prescribed to you, and using pills in any way other than the directions on them, is dangerous.
  • Taking too many prescription drugs at once or taking them too often can damage your organs and can kill you.
  • Taking pills to stay awake won’t help you focus or perform.
  • K2-Spice can cause a serious heart attack.
  • K2-Spice can make you very sick or even kill you.
  • There is help available to stop drinking, smoking, or doing drugs like marijuana, pills, and K2-Spice.

  1. Contestants must submit their video entries through the station’s website at www.kysdc.com.  All Internet entries must be received by 11:59 PM EST on July 15, 2012 or they will be void.

  1. Entries must be “family friendly”, appropriate for all audiences, and must meet the below-listed Entry Requirements.

  1. Entries will be posted online at www.kysdc.com for public voting.  The voting period will begin on July 16, 2012 and end at 11:59 PM EST on July 18, 2012.  Listeners of 93.9 WKYS-FM will be instructed to view the posted entries and vote on their favorite to determine the top twenty-five (25) entries.  The total number of votes each entry receives will be taken into consideration in the Contest winner selection process.  A distinguished panel of judges composed of Prince George’s County Health Department staff, staff from local youth outreach organizations, and LMD (Laurel Marketing Design) staff, will ultimately, in their sole discretion, determine the top twenty-five (25) entrants, which will be narrowed down to ten (10) semi-finalists, and from ten (10) semi-finalists down to three (3) finalists).  

  1. The top twenty-five (25) winning entries will be awarded a prize pack.  Ten (10) semi-finalists will be selected from among the twenty (25) prize pack winning contestants and will be awarded the opportunity to record their entry song at a professional recording studio in Baltimore, MD and will receive a CD containing the professional recording of their entry song (retail value: $400).  Three (3) finalists will be selected from among the ten (10) semi-finalists and will be awarded three (3) tickets to the 93.9 WKYS Russ Parr Summer Takeover (location TBA) and the opportunity to appear live on stage at the Summer Takeover on August 11, 2012 while their entry songs will be played before the event audience. The audience will vote for their favorite by applause, and one (1) grand prize winner will selected and awarded one (1) $300 Visa gift card.

Winners will be contacted during the week of July 23, 2012.  The top twenty-five (25) winning entries will be displayed on the Prince George’s County Health Department website.

  1.  One entry per person per email address during the Contest Period.   

  1.  In the event of a dispute regarding the identity of a participant’s online entry, the entry will be deemed to have been made by the authorized holder of the e-mail account at the time the entry was made. 

  1. By uploading a submission and entering this Contest, each participant represents and warrants to be bound by the Official Contest rules, that they are authorized to and have the rights to submit the content in the entry, and that all of the below-listed requirements have been met. 

Entry Requirements:

  • Video entries must not exceed ninety-three (93) seconds in length
  • Entries may not be patently offensive, illegal, pornographic or obscene, or similarly inappropriate in the Station’s sole discretion
  • Entries must be family friendly and not contain lewd or sexual content or references
  • Submissions may not infringe upon any rights of any third party including without limitation, copyright, trademark and right of publicity or privacy
  • Entries must not contain commercial products (e.g., clothing, toys, food) and/or their trademarks, brands, logos or endorsements
  • Entries must be produced and solely owned by the contestant submitting the entry
  • Entries must be unpublished and not have been submitted in other competitions
  • Submissions must not contain: unnecessary violence, derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliate other people (publicly or otherwise), or otherwise assault or threaten others
  • If additional individuals are featured in the entry, each entrant warrants and represents that the entrant has obtained permission from each person who appears in the submission

ELIGIBILITY RESTRICTIONS:

  1. The Contest is open to listeners of 93.9 WKYS-FM who are 13-24 years of age and are legal residents of the U.S. residing within Prince George’s County, Maryland.

  1. No more than three (3) contestants may perform vocally in each video entry.  Each winning entry will be awarded a single prize, regardless of whether one (1), two (2), or three (3) individuals are participating.  Prizes will be delivered via FedEx to the address of the registered contestant who submitted the entry.

  1. To qualify for the Contest, contestants MUST be available on the following dates in the event of being declared a semi-finalist or finalist.  Contestants unable to attend and participate in the following events are ineligible to win Finalist Prize or Grand Prize:
    • July 30, 2012 or July 31, 2012: Attendance required at in-studio recording session at a professional recording studio in Baltimore.  Semi-finalists will be notified via phone if their entry is selected as one of ten (10) semi-finalists and a 40-minute time slot will be scheduled for the recording session with the contestant.  For any video entry containing more than one performing contestant (up to three individuals), ALL contestants must be available to attend the same recording session or the entry will become ineligible to receive the semi-finalist prize.
    • August 11, 2012: Attendance required at 93.9 WKYS Russ Parr Summer Takeover Concert for the three (3) finalists.  Finalists must stand on stage while their song is played for the event audience.

 

  1. Employees of 93.9 WKYS-FM, Radio One, Inc. (“Radio One”), the Prince George’s County Health Department, or LMD their respective subsidiaries, affiliates, general sponsors, advertisers, competitors, promotional partners, other radio stations in the Prince George’s County area, and members of the immediate families or those residing in the households (whether related or not) of any of the above are NOT eligible to participate or win in this Contest.  For purposes of this Contest, immediate family members mean spouses, parents, grandparents, children, and siblings and their respective spouses.

  1. Once an individual wins a prize in this Contest, they are not eligible to win another prize in this Contest except as specified within these rules.

  1. Persons who have won a prize in another contest or promotion of any kind from 93.9 WKYS-FM within the thirty (30) day period immediately preceding the start date of this Contest are not eligible to participate.  Only one person per family or household (whether related or not) may win in any promotion from 93.9 WKYS-FM during any thirty (30) day period.

PRIZES:

  1. The top twenty-five (25) entrants will each be awarded a qualifying prize pack which will include the following:

a. One (1) T-shirt

b. One (1) gift card from a local retailer in the amount of Twenty Five Dollars ($25).  Gift cards are subject to terms and conditions specified by issuer.

c. Prize packs will be delivered to winners via FedEx

  1. Ten (10) semi-finalists will each be awarded the following:

a. Forty (40) minutes of studio time in a professional production studio in Baltimore, MD on July 30, 2012 or July 31, 2012. Winning contestants will be contacted by phone to confirm an available time slot. 

b. One (1) CD with recording of entry song

c. Transportation to and from the recording session in Baltimore will be the responsibility of the winner.

d. Retail value of prize is Four Hundred Dollars ($400)

  1. Three (3) finalists will each be awarded the following:

a. Three (3) tickets to the 93.9 WKYS Russ Parr Summer Takeover (location TBA). 

b. Tickets will be delivered to winners via FedEx.

b. Transportation to Summer Takeover will NOT be provided by 93.9 WKYS-FM or the Prince George’s County Health Department. Contestants must secure transportation arrangements to attend this event.

  1. One (1) Grand Prize winner will be awarded the following:

a.  One (1) Visa gift card valued at Three Hundred Dollars ($300).  Gift cards are subject to terms and conditions specified by issuer.

  1. To the extent that prize elements are provided by third-party providers, winner agrees to look solely to applicable prize providers with respect to any claims, losses, or disputes in connection therewith.

  1. Dates and times of concerts, activities, and trips promoted by Contest sponsors are subject to change and those changes are deemed to be beyond the control of 93.9 WKYS-FM and the Prince George’s County Health Department. Changes of venue, cancellation of engagements by performing artists, and/or their management may be permanent in nature.  93.9 WKYS-FM and the Prince George’s County Health Department are not obligated to make any effort to find an alternative prize under these circumstances.

  1. Prizes that are not mailed (via U.S. mail or FedEx) or provided by the participating sponsor must be claimed at the offices of the Station.

  1. No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except as determined by 93.9 WKYS-FM management and/or the sponsor in its sole discretion.

  1. All contest winners must sign and date official 93.9 WKYS-FM release and waiver forms as requested.  Failure to do so will result in winner forfeiting the prize.  If a winner is under the age of eighteen (18), all release and waiver forms must be signed by the winner’s parent or legal guardian.

  1. If for any reason a contest winner decides not to accept an awarded prize, the winner will be required to sign a release form acknowledging forfeiture of the prize.  It will be at the discretion of the contest sponsor and/or contest administrator if another contestant is to be selected as the winner if time permits.

  1. Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.  If a winner is under the age of eighteen (18), valid identification must be provided by the winner’s parent or legal guardian.

EXECUTION:

  1. During the Contest Period, eligible listeners will be encouraged to participate in the Contest by registering through the Contest website on www.kysdc.com.  Using the provided “Give Drugs a Bad Rap” 93-second music beat, contestants are to create their own original 93-second song, rap, or poem.  Each entry must include AT LEAST three (3) of the provided anti-drug and/or anti-alcohol messages to qualify for a chance to win.

  1. Prize pack winners, semi-finalists, and finalists will be notified by phone and provided with instructions for claiming their prize.

  1. The Contest will progress in the following manner: 
    1. Contestants must register online at www.kysdc.com.
    2. Entries will be posted online for public voting
    3. Winners will be notified by phone during the week of July 23, 2012.
    4. Prize packs for each of the top twenty-five (25) entrants will be delivered to the winner’s address via FedEx.
    5. The ten (10) semi-finalist winners will be contacted to confirm their availability on July 30, 2012 or July 31, 2012 for an in-studio recording session at a production studio in Baltimore, MD.
    6. The three (3) finalists will be contacted to confirm their availability on August 11, 2012 for attendance on stage at the 93.9 WKYS Russ Parr Summer Takeover.
    7. One (1) grand prize winner will be determined based on audience response during the Event.

  1. All decisions made by 93.9 WKYS-FM, Radio One, and the Prince George’s County Health Department management regarding any aspect of this Contest are final.

GENERAL CONDITIONS:

  1. Winners are responsible for all applicable taxes associated with the receipt of the prize.

  1. Any person winning over $600.00 in prizes will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law.

  1. No purchase necessary.  Contest is void where prohibited.  Contest is subject to all applicable federal, state and local laws and regulations.

  1. Odds of winning depend upon the number of eligible contestants participating during the Contest Period.

  1. By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation, and must sign a publicity release prior to acceptance of the prize.  By entering this Contest, each participant agrees to comply with the Official Rules and the decisions of the contest sponsor which shall be final and binding in all aspects relating to the contest.  

  1. All contest winners will be required to sign a liability release prior to acceptance of any prize.  Pursuant to the liability release, the winner or winners will agree to hold 93.9 WKYS-FM, Radio One, the Prince George’s County Health Department, any other contest parties and each of their respective affiliates, subsidiaries, agencies, officers, shareholders, directors, employees, agents and representatives of each of the foregoing, harmless against any and all claims or liability, directly or indirectly related to or arising from or in connection with contest participation or the acceptance, possession or use / misuse of awarded prize or any portion thereof, or participation in prize-related activities, including but not limited to any related travel.       

  1. Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.

  1. 93.9 WKYS-FM retains the right to disqualify any contestant if all contest rules are not followed.  Contest void if prohibited by law.

  1. So long as no participant is materially adversely affected, 93.9 WKYS-FM reserves the right to make changes in the contest rules, which will become effective upon being announced on the air and / or posted online.

  1. 93.9 WKYS-FM, Radio One, the Prince George’s County Health Department, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any contestant to complete or continue a telephone call, facsimile transmission or internet registration due to equipment malfunction, busy lines, inadvertent disconnections, communication failures or human error that may occur in the transmission, receipt or processing of entries.  In addition, 93.9 WKYS-FM, Radio One, the Prince George’s County Health Department, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for lost, misdirected, mutilated, illegible or incomplete contest entries.  Once submitted, entries become the property of 93.9 WKYS-FM and will not be returned.

  1. By accepting the prize, the winner acknowledges that 93.9 WKYS-FM, Radio One, and the Prince George’s County Health Department, have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.

  1. 93.9 WKYS-FM, Radio One, the Prince George’s County Health Department, its subsidiaries, its affiliates, participating sponsors and promotional partners will not assume any responsibility for any changes in the execution of the contest, including; cancellation of the contest as a result of the occurrence of events not within the control of 93.9 WKYS-FM, Radio One, the Prince George’s County Health Department, its subsidiaries, affiliates, participating sponsors, promotional partners and other radio stations, such as acts of God, strikes, terrorists acts or criminal acts of third parties.  In the event, such an act should occur; the Station may in its sole discretion offer the winner comparable prize(s) currently being offered by 93.9 WKYS-FM in lieu of the prize originally awarded.      

  1. If for any reason, the Contest is not capable of running as planned, including without limitation, any suspected evidence of tampering or technological corruption or if any portion of the Contest is compromised by virus, bugs, worms or unauthorized human intervention, fraud, an insufficient number of qualified Contest entries, or any other causes beyond 93.9 WKYS-FM and Radio One’s, control which, in 93.9 WKYS-FM and Radio One’s sole opinion, corrupts, threatens or impairs the administration, security, fairness, integrity, or proper conduct of the Contest, 93.9 WKYS-FM and Radio One reserve the right to cancel, terminate, modify or suspend the Contest at their sole discretion.

  1. Any attempt by an entrant to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil laws and should such an attempt be made, WKYS-FM and Radio One reserve the right to seek remedies and damages (including attorney's fees) from any such entrant to the fullest extent of the law, including criminal prosecution.

  1. Copies of contest rules are available upon request during regular business hours, Monday – Friday 9:00 a.m. to 5:00 p.m., in the offices of 93.9 WKYS-FM, located at 8515 Georgia Avenue, Silver Spring, MD 20910.  Copies of contest rules may also be made available during on-site / in-person remote events.
