The DMV's Next Music Star
CONTEST RULES
CONTEST DESCRIPTION:
The DMV's Next Music Star contest (“Contest’) will begin on May 31, 2011 and end on July 21, 2011 (“Contest Period”). One (1) grand prize winner will be awarded a single record contract with Koch/E1 Records and a scheduled slot to perform during the Russ Parr "Splash Bash" at Six Flags America in Largo, Maryland.
HOW TO ENTER:
Listeners of WKYS-FM who are legal residents of the U.S., residing within the Washington DC metropolitan area (DC, Maryland, and Virginia), and are 18 years of age and older will be able to take part in this Contest. To participate in the Contest, listeners must do the following:
Local music artists must submit their original, clean edited, sample-free song to KYSDC.com between May 29, 2011 and June 8, 2011 for a chance to become “The DMV’s Next Music Star”. Accepted song files are MP3 only. Submitted songs should be no longer than five (5) minutes in length. Songs containing explicit language or not using original, sample-free instrumentation will be rejected. Contestants must perform an original song. No covers or sampling of other artists’ material or music is permitted, and will lead to disqualification.
1.Upon entering the Contest website, participants are to follow the on-screen instructions, including entering their name, date of birth, address, phone number, email address, song entry, and any optional or additional contact information, as requested, to register for a chance to win.
2.All Internet entries must be received by 11:59pm EST on June 21, 2011, or they will be void.
3.Entries will be posted online for public voting. The voting period will take place from May 31, 2011 through June 21, 2011.
4.Eight (8) contestants that receive the highest number of online votes and two (2) wild card contestants (for a total of ten (10) finalists) will be invited to perform at a live event that will be recorded. If a finalist fails to attend the live performance event, they will be ineligible for a chance to win the grand prize. Finalists’ performances will be recorded during the event and the recorded performances will be posted online for a second round of online voting to determine the grand prize winner.
5.By uploading a submission and entering this Contest, each participant represents and warrants to be bound by the Official Contest rules, that they are authorized to and have the rights to submit the content in the entry, and that all of the below-listed requirements have been met.
6.One entry per person per day per email address during the Contest Period.
7.In the event of a dispute regarding the identity of a participant’s online entry, the entry will be deemed to have been made by the authorized holder of the e-mail account at the time the entry was made.
Entry Requirements:
•Entry must be five (5) minutes or less in length
•Entries may not be patently offensive, illegal, pornographic or obscene, or similarly inappropriate in Sponsors’ sole discretion.
•Entries must be family friendly and not contain any profanity, obscene language, lewd or sexual content or references.
•Submissions may not infringe upon any rights of any third party including without limitation, copyright, trademark and right of publicity or privacy
•Entries must be produced and solely owned by the contestant submitting the entry
•Entries must be unpublished and not have been submitted in other competitions
•Submissions must not contain: unnecessary violence, derogatory characterizations of any ethnic, racial, sexual or religious groups, humiliate other people (publicly or otherwise), or otherwise assault or threaten others
•If additional individuals are featured in the entry, each entrant warrants and represents that the entrant has obtained permission from each person who appears in the submission
ELIGIBILITY RESTRICTIONS:
1.The Contest is open to listeners of WKYS-FM who are 18 years of age and older and are legal residents of the U.S. residing within the Washington DC metropolitan area.
2.Employees of WKYS-FM, Radio One, Inc. (“Radio One”), its subsidiaries, affiliates, general sponsors, advertisers, promotional partners, other radio stations in the Washington, DC metropolitan area, and members of the immediate families or households of any of the above are NOT eligible to participate or win in this Contest.
3.Once an individual wins a prize in this contest, they are not eligible to win another prize in this contest except as specified within these rules.
4.Persons who have won a prize in another contest or promotion of any kind from WKYS-FM within the thirty-day (30) period immediately preceding the start date of this contest are not eligible to participate.
PRIZES:
Grand Prize package will include the following:
•An offer of a recording contract for a single record deal with Koch / E1 Records (provided by Koch / E1 Records). The music contract being offered holds that Koch / E1 Records will produce, distribute and market one (1) single for the winning entrant. Winner shall look solely to the record company with respect to any claims, losses or disputes in connection with the recording contract. WKYS-FM and Radio One, Inc. shall not be a party to said agreement and shall not be responsible for any obligations thereunder. Dates for fulfillment of the recording agreement (between the contest winner and the sponsoring record company) shall be determined by the applicable prize provider.
•A scheduled performance slot during the Russ Parr "Splash Bash" at Six Flags America in Largo, Maryland on July 16, 2011 (provided by WKYS-FM).
Additional Prizing:
Finalists that participate in the live performance event will be eligible for additional prizing. During the live performance event, club patrons will be invited to vote for their favorite performer via text message.
The three (3) finalists receiving the most votes via text message will be awarded professional recording studio time (including mixing and mastering) provided by Omega Recording Studios. Studio time will include assistance from the studio’s engineer / technician. Studio time must be used within six (6) months of being awarded. Prizes are as follows:
•First Place – five (5) hours of studio time
•Second Place – three (3) hours of studio time
•Third Place – two (2) hours of studio time
To the extent that prize elements are provided by third-party providers, winner shall look solely to applicable prize providers with respect to any claims, losses, or disputes in connection with the Prize.
1.Prizes that are not mailed (via us mail or UPS) or provided by the participating sponsor must be claimed at the station’s offices within thirty (30) days of the date of winning.
2.No substitution of prize is offered, no transfer of prize to a third party is permitted and non-cash prizes may not be redeemed for cash value, except as determined by station management and/or the sponsor in its sole discretion.
3.All contest winners must sign and date official station release and waiver forms as requested. Failure to do so will result in winner forfeiting the prize.
4.If for any reason a contest winner provides notice that they have decided not to accept an awarded prize, the winner will be required to sign a release form acknowledging forfeiture of the prize. It will be at the discretion of the Contest sponsor and / or Contest administrator if another contestant is to be selected as the winner if time permits.
5.If contest winner does not claim their prize within 30 days of winning notification, the prize will be forfeited.
6.Winners must provide valid identification (i.e. via driver’s license, passport or other government-issued photo I.D.) to claim their prize.
EXECUTION:
1.During the Contest Period, eligible listeners will be encouraged to participate in the Contest by submitting their original, clean edited, sample-free song to KYSDC.com between May 29, 2011 and June 8, 2011 to have a chance to become “The DMV’s Next Music Star”. 3.The top ten (10) contestants with the most online votes will be contacted by phone and email, and invited to perform their submitted material for a live event at Ibiza Night Club on June 24, 2011.
4.If a finalist fails to attend the live performance event at the Night Club, they will be ineligible for a chance to win the grand prize. Transportation to and from the performance venue will be the participant’s responsibility.
5.Finalists participating in the live event will be eligible to win additional prizing. Club patrons will be invited to vote for their favorite performer via text message. Each finalist will be assigned his or her own text message short code number that will be announced. To participate in the text voting process, club patrons must send the word VOTE to the designated short code number assigned to a particular finalist. Standard text and data rates will apply.
6.The three (3) finalists receiving the most votes via text message during the live competition will be awarded professional recording studio time provided by Omega Recording Studios.
7.Performances from all of the participating finalists will be video recorded by WKYS-FM and uploaded to KYSDC.com for public voting. Listeners will be able to vote for their favorite Top 10 Finalist’s video on the station's website from June 27, 2011 through July 8, 2011.
8.The finalist receiving the greatest number of online votes by the end of the voting period will be declared the grand prize winner. The grand prize winner will be notified by telephone and email on or about July 12, 2011 and provided with instructions for claiming the grand prize.
9.All decisions made by WKYS-FM management regarding any aspect of this Contest are final.
GENERAL CONDITIONS:
1.Winners are responsible for all applicable taxes associated with the receipt of the prize (prizes are not transferable and may not be exchanged).
2.Any person winning over $600.00 in prizes will receive an IRS form 1099 at the end of the calendar year for tax purposes and a copy of such form will be filed with the IRS as required by law.
3.No purchase necessary. Contest is void where prohibited. Contest is subject to all applicable federal, state and local laws and regulations.
4.Odds of winning depend upon the number of eligible contestants participating during the Contest Period.
5.By participating in the Contest, the winner or winners agree to have their name, voice, or likeness used in any advertising or broadcasting material relating to this contest, in any media now known or hereafter devised for advertising or promotional purposes without additional compensation, and must sign a publicity release prior to acceptance of the prize. By entering this Contest, each participant agrees to comply with the Official Rules and the decisions of the contest sponsor which shall be final and binding in all aspects relating to the Contest.
6.All contest winners will be required to sign a liability release prior to acceptance of any prize. Pursuant to the liability release, the winner or winners will agree to hold WKYS-FM, Radio One, any other contest parties and each of their respective affiliates, subsidiaries, agencies, officers, shareholders, directors, employees, agents and representatives of each of the foregoing, harmless against any and all claims or liability, directly or indirectly related to or arising from or in connection with contest participation or the acceptance, possession or use / misuse of awarded prize or any portion thereof, or participation in prize-related activities, including but not limited to any related travel.
7.Winners must provide valid identification (i.e. via driver’s license, passport or other photo I.D.) to claim their prize.
8.The station retains the right to disqualify any contestant if all contest rules are not followed, contest void if prohibited by law.
9.So long as no participant is materially adversely affected, the station reserves the right to make changes in the contest rules, which will become effective upon being announced on the air or posted on KYSDC.com.
10.WKYS-FM, Radio One, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for the inability of any contestant to complete or continue a telephone call, facsimile transmission or internet registration due to equipment malfunction, busy lines, inadvertent disconnections, unavailable network, server, Internet Service Provider (ISP) or other connections, communication failures or human error that may occur in the transmission, receipt or processing of entries. In addition, WKYS-FM, Radio One, participating sponsors and their respective parent companies, subsidiaries, affiliates or their representatives, agents and employees are not responsible for lost, misdirected, mutilated, illegible or incomplete contest entries. Once submitted, entries become the property of the station and will not be returned.
11.By accepting the prize, the winner acknowledges that WKYS-FM and Radio One have neither made, nor are in any manner responsible or liable for, any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize or to any portion thereof, including but not limited to its quality, mechanical condition or fitness for a particular purpose.
12.WKYS-FM, Radio One, its subsidiaries, its affiliates, participating sponsors and promotional partners will not assume any responsibility for any changes in the execution of the contest, including; cancellation of the contest as a result of the occurrence of events not within the control of WKYS-FM, Radio One, its subsidiaries, affiliates, participating sponsors, promotional partners and other radio stations, such as acts of God, strikes, terrorists acts or criminal acts of third parties. In the event, such an act should occur; reasonable attempts will be made to offer the winner comparable prize(s) currently being offered by the station in lieu of the prize originally awarded.
13.If for any reason, the Contest is not capable of running as planned, including without limitation, any suspected evidence of tampering or technological corruption or if any portion of the Contest is compromised by virus, bugs, worms or unauthorized human intervention, fraud, an insufficient number of qualified Contest entries, or any other causes beyond WKYS-FM and Radio One’s control which, in WKYS-FM and Radio One’s sole opinion, corrupts, threatens or impairs the administration, security, fairness, integrity, or proper conduct of the Contest, WKYS-FM and Radio One reserve the right to cancel, terminate, modify or suspend the Contest at their sole discretion.
14.Any attempt by an entrant to deliberately undermine the legitimate operation of the Contest may be in violation of criminal and civil laws and should such an attempt be made, WKYS-FM and Radio One reserve the right to seek remedies and damages (including attorney's fees) from any such entrant to the fullest extent of the law, including criminal prosecution.
15.Copies of contest rules are available upon request during regular business hours, Monday – Friday 9:00 a.m. to 5:00 p.m., in the offices of WKYS-FM, located at 5900 Princess Garden Parkway, 8th floor, Lanham, Maryland 20706. Copies of contest rules may also be made available during on-site / in-person remote events.
